  On July 2, the State Administration of Market Supervision promulgated the Provisions on Administrative Punishment for Price Violations (Revised Draft for Comment) (hereinafter referred to as the "Provisions") for public comments.

  The Paper reporter noted that the Provisions on Administrative Punishment for Price Violations was approved by the State Council on July 10th, 1999, and was revised three times in 2006, 2008 and 2010. Compared with the previous version, the highlight of this revised draft for comments is the addition of "price violations in new formats".

  It is mentioned in this clause that in any of the following circumstances, a warning shall be given and the total sales of the previous year may be fined 1‰ The above 5 & permit; The following fines, illegal income, confiscate the illegal income; If the circumstances are serious, it shall be ordered to suspend business for rectification or revoke its business license.

  These situations include: e-commerce platform operators use big data analysis, algorithms and other technical means to set different prices for the same goods or services under the same trading conditions based on the preferences and trading habits of consumers or other operators and factors other than cost or legitimate marketing strategies. Commonly known as "big data killing."

  In addition, the price violations specified in this clause also include the dumping of e-commerce platform operators who do not have a dominant market position at a price lower than the cost through subsidies and other forms in order to crowd out competitors or monopolize the market, disrupting the normal production and operation order and harming the national interests or the legitimate rights and interests of other operators.

  Chen Wenming, a lawyer of Zhejiang Xiaode Law Firm, told The Paper that the Regulations on Administrative Penalties for Price Violations revised by the State Administration of Markets is to meet the needs of the economic development of the times, especially the economic development of Internet e-commerce.

  Multi-level laws and regulations regulate the killing of big data, with a total sales volume of 5‰ Fines and suspension of business for rectification have great deterrent power.

  At present, many laws and regulations have been promulgated to restrict the killing of big data, including the E-commerce Law, the Anti-monopoly Law and the Price Law. Different laws differ in punishment intensity, regulation scope and treatment cycle.

  Compared with the fine imposed by the E-Commerce Law, the Provisions on Administrative Penalties for Price Violations is relatively more deterrent.

  The first paragraph of Article 18 of the E-Commerce Law, which was officially implemented in January 2019, stipulates: "If an e-commerce operator provides search results of goods or services to consumers according to their hobbies, consumption habits and other characteristics, it should also provide the consumers with options that are not specific to their personal characteristics, and respect and equally protect the legitimate rights and interests of consumers."

  The "Electronic Commerce Law" imposes a maximum penalty of 500,000 yuan for violating this clause. However, the punishment standard for killing illegal big data in the Draft of Provisions is completely different, and it is proposed that the total sales of the previous year should be 1‰ The above 5 & permit; The following fine punishment measures, if the circumstances are serious, may even be ordered to suspend business for rectification, or revoke the business license.

  Liang Zheng, a professor at the School of Public Administration of Tsinghua University and secretary-general of the Academic Committee of the Tsinghua University Research Center for Science and Technology Development and Governance, told the The Paper that the usual punishment for price violations is to confiscate the illegal income or impose a fine several times the illegal income, and impose a 1 & permit; The above 5 & permit; The following fines are severe, with a strong punitive nature and a greater deterrent to enterprises.

  However, Liang Zheng believes that this penalty clause needs to be further clarified.   Liu Xu, a special researcher of Tsinghua University National Institute of Strategic Studies, expressed support for "suspending business for rectification and revoking marketing license".   Compared with the lengthy enforcement cycle of the Anti-Monopoly Law, the Provisions on Administrative Punishment for Price Violations is more convenient in law enforcement.

  The clause in the Anti-Monopoly Law related to big data killing is Article 17, paragraph 6, which stipulates that "without justifiable reasons, different treatment is given to counterparties with the same conditions on trading conditions such as trading price", which constitutes an abuse of market dominance and should be prohibited. "The subject to which this clause refers is" an operator with a dominant market position ". This time, the "Regulations" will expand the main body to e-commerce platform operators.

  In addition to the expansion of the scope of application of the Regulations, Liu Xu also believes that the Anti-Monopoly Law has a long enforcement period and is difficult to prove. "From the perspective of price enforcement, the current Regulations are relatively simple and should be more convenient to implement. This is a positive place."

  It is difficult to prove that big data is cooked. What else needs to be done besides laws and regulations?

  The dimension of laws and regulations has clarified the crackdown and punishment on big data killing, and the dimension of daily supervision is also making efforts to solve the problem of difficult evidence collection for big data killing.

  Chen Wenming, a lawyer of Zhejiang Xiaode Law Firm, pointed out that the difficulty of big data supervision in the past was how to supervise algorithms. "The behavior of supervising big data killing is not simply to monitor the company, but to monitor the company’s algorithm. No Internet company will fully disclose its own algorithm, which is the biggest difficulty in supervising big data killing." He further explained that if you really want to supervise the killing behavior, you should supervise the algorithms of various enterprises and let them publish these algorithms, at least to the regulatory authorities, so that the regulatory authorities can have evidence to check. This is the first step for everyone to supervise these Internet companies.

  Liang Zheng, a professor at the School of Public Administration of Tsinghua University and secretary-general of the Academic Committee of Tsinghua University Science and Technology Development and Governance Research Center, also believes that big data is hidden, it is difficult to obtain evidence, and it is difficult to investigate and deal with it.

  Liang Zheng suggested that you can try the following regulatory tools:

  First, play the role of whistleblower. Encourage employees in peer companies or enterprises to actively report big data killing behavior and provide clues and evidence materials for regulators.

  Second, the use of big data monitoring technology to achieve smart supervision. Platform enterprises have the advantages of data, algorithm and technology, and there is an information gap between regulators and enterprises. Regulators can realize real-time monitoring through big data monitoring system.

  Third, cooperation between government and enterprises to achieve coordinated supervision. If the traditional antagonistic relationship between regulators and enterprises continues, platform governance can only become a "cat and mouse" game, which cannot effectively solve the problem of killing big data. The cooperation and cooperation between regulators and enterprises should be strengthened, and enterprises should be encouraged to be self-compliant. Regulators can require enterprises to provide internal compliance explanations or price policies to monitor the effect of their self-compliance.

  Some regions have made very valuable explorations. In March 2021, the "Zhejiang Fair Online" system, which was developed and built by Zhejiang Market Supervision Bureau, was launched for monopoly and improper behaviors in the platform economy.

  According to reports, "Zhejiang Fair Online" relies on the national online trading monitoring platform, and its monitoring scope covers major online trading platforms such as Taobao, Tmall, JD.COM, Pinduoduo, Meituan and Suning.cn. It can dynamically monitor the qualifications of platform economic operators, trading rules, brand goods, sales prices and other information in real time, and illegally implement operator concentration.

  The community group buying platform has been fined many times, and the Regulations have turned law enforcement experience into clear rules.

  In addition to regulating the killing of big data, another highlight of the Regulations is that in the section of "Price violations in new formats", "the price violations specified under this clause also include the dumping of e-commerce platform operators who do not have a dominant market position at a price lower than the cost through subsidies and other forms, disrupting the normal production and operation order and harming the national interests or the legitimate rights and interests of other operators" is clearly illegal.

  Since the beginning of this year, many community group buying platforms have been punished for allegedly dumping at low prices. In March, the General Administration of Market Supervision imposed administrative penalties on unfair price behaviors of five community group buying enterprises, among which illegal behaviors included "low-price dumping" behavior of selling goods below the purchase cost through huge subsidies. In May, the General Administration of Market Supervision imposed a fine of 1.5 million yuan on the 10th Club, and ordered the 10th Club platform in Jiangsu to suspend business for 3 days. After investigation, it was found that the 10th Club sold goods at a price lower than the purchase cost through huge subsidies.

  Therefore, in the view of Liu Xu, a special researcher of Tsinghua University National Institute of Strategic Studies, the Regulations have turned the law enforcement experience in the past six months into clear rules to guide enterprises and new formats. In 2017, the number of fixed broadband access users of the three basic telecommunications enterprises reached 348.54 million, a net increase of 51.33 million in the whole year; The total number of 4G users reached 997 million, with a net increase of 227 million. The penetration rate of fixed broadband households reached the 2020 target ahead of schedule. The proportion of high-speed broadband users has increased significantly, with 135 million fixed Internet broadband access users with access rates of 100Mbps and above, accounting for 38.9% of the total users, accounting for an increase of 22.4 percentage points over the previous year. E-commerce has maintained rapid development and become an important engine to stimulate consumer demand and develop modern service industry. Online retail sales reached 7,175.1 billion yuan, a year-on-year increase of 32.2%. The level of integration of informatization and industrialization has been further improved, and significant progress has been made in digitalization, networking and intelligence of key industries, with the numerical control rate of key processes reaching 46.4%.

  -Information services.The level of social informatization continued to improve, and information benefited the people, facilitated the people and developed in depth. In 2017, the number of netizens in China reached 772 million, an increase of 40.74 million compared with 2016. The number of social security card holders nationwide reached 1.088 billion.   Major breakthroughs have been made in basic technology and general technology.Integrated circuits have achieved mass production in 28 nm process, and the chip design level has moved towards 10 nm. Successfully developed more than 30 kinds of high-end equipment such as 14 nm etcher and thin film deposition, and hundreds of material products such as target and polishing solution to fill the gap in the industrial chain. The research and development capability of artificial intelligence has been significantly improved.The innovation ability of information technology has been significantly enhanced.In 2017, China’s innovation index rose to 22nd place in the global ranking, and it was the only middle-income country that entered the top 25, ranking among the global innovation leaders. The relevant departments of the state have implemented the strategy of "Broadband China" in depth, promoted the construction of land, sea, air and space integrated information infrastructure, made overall plans for the application of infrastructure construction and the allocation of spectrum resources, implemented the national new-generation information infrastructure construction project and the broadband upgrading project in rural and remote areas, accelerated the establishment of a ubiquitous advanced information infrastructure system, and basically built a modern information infrastructure with the best performance and the largest scale in the world.

  Speed up the construction of high-speed broadband networks.In 2017, the number of Internet broadband access ports reached 779 million, and the penetration rate of fixed broadband households reached 72%. The construction of optical network cities has entered the fast lane, with 293.92 million optical fiber broadband access users, and broadband users above 50Mbps account for more than 70% of the total users nationwide, and some areas have begun to provide gigabit broadband services. The total number of mobile broadband users reached 1.13 billion, the mobile Internet access traffic was 24.6 billion GB, up 162.7% year-on-year, and the scale of 4G users exceeded 1 billion. The comprehensive population coverage of national radio programs is 98.71%, and there are 220 million cable TV users, including 198 million cable digital TV users, more than 89 million cable digital HD users and 129 million national direct broadcast satellite users.The process of air and space integration has been accelerated.In April 2017, China’s first Qualcomm mass communication satellite, Shijian 13, was successfully launched and delivered in January 2018. During the on-orbit test, the first international high-speed laser two-way communication test between high-orbit satellites and the ground was successfully carried out. Rural netizens accounted for 27% of netizens, with a scale of 209 million, and the rural Internet penetration rate rose to 35.4%. The coverage rate of broadband network in poor villages exceeds 90%, and the target set in the 13 th Five-Year Plan has been completed ahead of schedule.Network speed-up and fee reduction continued to advance.In the third quarter of 2017, the weighted average download rate of fixed broadband users in China was 16.4Mbit/s, a year-on-year increase of 48.7%.   Data resources are increasingly becoming an important factor of production and social wealth, and the amount of information mastered has become an important symbol of a country’s soft power and competitiveness. At the national level, the Action Plan for Promoting the Development of Big Data, Several Opinions on Promoting the Opening of Public Information Resources, and the Development Plan of Big Data Industry (2016-2020) have been successively issued to strengthen the planning and construction of data resources, accelerate the improvement of digital infrastructure, promote the integration and sharing of data resources, and promote the innovation and development of big data technology industry. Relevant state departments have accelerated the construction, effective integration and safe utilization of data resources in key areas, and continuously improved the online sharing and service capabilities of data resources.

  The overall planning and construction of the national data resource system was accelerated.Promote the establishment and improvement of a basic data system and accelerate the construction of a unified, efficient, interconnected, safe and reliable national data resource system.The open application mechanism of data resource sharing has been gradually improved.Accelerate the construction of a data sharing platform with nationwide coverage, overall utilization and unified access, promote the construction of national big data development projects, and basically build basic databases such as population, legal persons, natural resources, geographical space and macroeconomics. The national population basic information database has passed the acceptance and provided services to the national government departments. Accelerate the integration and sharing of academic resources in the field of philosophy and social sciences. The National Literature Center of Philosophy and Social Sciences has integrated more than 16 million academic information resources of philosophy and social sciences, with more than 9.3 million online academic papers and accumulated downloads of more than 10 million. Accelerate the improvement of the scientific big data resource system and the construction of public service cloud platform. Public security organs across the country have fully implemented the big data strategy, realized cross-regional, cross-departmental and cross-police information sharing, upgraded information processing from single aggregation to multiple services, promoted a major breakthrough in the new mechanism to combat crime, and comprehensively improved the detection rate by using information technology, greatly shortening the detection cycle of homicide cases and significantly reducing the overall detection cost.The security of big data is gradually unfolding.The "Network Security Law" was promulgated and implemented, and the overall requirements for ensuring data security were clearly defined. We will step up the formulation of the Regulations on the Security Protection of Key Information Infrastructure, strengthen the security protection of key information infrastructure and big data, and relevant departments will strengthen joint rectification of illegal data transactions.Innovation and development of big data technology industry.According to the calculation of relevant institutions, the scale of China’s big data core industry in 2017 was 23.4 billion yuan, a year-on-year increase of 39%. Big data applications are expanding from Internet, telecommunications, finance, transportation, medical care and other fields to traditional fields. China’s large Internet enterprises are among the top in the world in terms of mass data collection, storage and processing.

  (D) The digital economy is booming.

  At present, the world economy is accelerating the transformation to economic activities with the network information technology industry as the important content. To adapt to the new normal of leading economic development, the State Council issued Guiding Opinions on Further Expanding and Upgrading Information Consumption and Releasing the Potential of Domestic Demand, Guiding Opinions on Actively Promoting "internet plus" Action and Made in China 2025. Relevant state departments jointly studied and formulated the Strategic Outline for the Development of Digital Economy, and formulated and implemented the Guiding Opinions on Promoting the Development of Sharing Economy to vigorously promote the healthy development of digital economy and sharing economy. We will accelerate the implementation of special actions such as e-commerce, "Advanced Manufacturing Industry in internet plus", "Modern Agriculture in internet plus" and "Convenient Transportation in internet plus" to promote the integrated development of digital economy and real economy.

  In terms of digital industrialization, new technologies, new industries, new formats and new models are constantly emerging.In 2017, the scale of China’s digital economy reached 27.2 trillion yuan, up 20.3% year-on-year, accounting for 32.9% of GDP, which has become an important driving engine for economic transformation and upgrading. The electronic information manufacturing industry, software and information service industry, and communication industry continued to develop rapidly. In 2017, the revenue scale of the information industry reached 22.1 trillion yuan, a year-on-year increase of 14.5%. The output of smart TVs was 96.66 million, an increase of 3.8%. The output of industrial robots was 130,000 sets, an increase of 81.0%. The output of civil drones was 2.9 million, an increase of 67.0%. Software business revenue was 5.5 trillion yuan, up 13.9% year-on-year. In 2017, the scale of information consumption in China increased to 4.5 trillion yuan, up 15.4% year-on-year, which was about twice the growth rate of final consumption in the same period, accounting for 10% of final consumption and contributing more than 0.4 percentage points to GDP growth. Mobile payment has gradually realized full-scene consumption, and the scale of mobile payment transactions has exceeded 200 trillion yuan, ranking first in the world. The overall strength and global competitiveness of China’s online information enterprises have been continuously improved, and the market value of seven Internet companies ranks among the top 20 in the world.

  In terms of industrial digitalization, informatization has become an important power engine to promote the quality change, efficiency change and power change of economic development and improve the total factor productivity.In-depth implementation of the "Guiding Opinions on Deepening the Integrated Development of Manufacturing Industry and Internet" and "Guiding Opinions on Deepening the Advanced Manufacturing Industry in internet plus to Develop Industrial Internet" will promote the in-depth integrated development of manufacturing industry and Internet, and the characteristics of software definition, data-driven, platform support, service value-added and intelligent leadership will become increasingly obvious. The development level of integration of industrialization and informatization has increased from 50.7 in 2016 to 51.8 in 2017. The penetration rate of digital R&D design tools for industrial enterprises above designated size has reached 63.3%, and the numerical control rate of key processes has reached 46.4%. With the rapid development of industrial internet, a number of new industrial apps for complex products such as high-speed rail and wind power have been formed and initially commercialized. The intelligent manufacturing project has been implemented in depth, and 428 intelligent manufacturing projects have been carried out. The innovation drive has been continuously enhanced. 120 "double-innovation" demonstration bases have been built in two batches across the country. The penetration rate of "double-innovation" platforms for key manufacturing enterprises has reached 70%, and new modes and formats such as networked collaborative manufacturing, personalized customization and service-oriented manufacturing have continued to emerge. The pace of informatization in agriculture and rural areas has been significantly accelerated. The project of information entering villages and households has been fully implemented, and demonstrations of information entering villages and households have been carried out in 10 provinces and cities throughout the province. A total of 169,000 agricultural information societies have been built and operated nationwide, and 233 million people have been provided with convenience services. Create a number of digital agriculture demonstration models, and constantly improve the level of agricultural production intelligence, network management and online service. The 13th Five-Year Development Plan for E-commerce was implemented, and e-commerce was upgraded.In 2017, China’s online retail sales reached 7,175.1 billion, up 32.2% year-on-year, and cross-border electronic commerce increased by more than 30% year-on-year. Rural e-commerce has developed rapidly, and the online retail sales in rural areas nationwide reached 1.24 trillion, a year-on-year increase of 39.1%. In 2017, the transaction volume of the sharing economy market was about 4.9 trillion yuan, an increase of 47.2% over the previous year. Accelerate the "convenient transportation in internet plus" and develop intelligent transportation to facilitate passengers’ travel. Build and improve the national public information platform for transportation logistics, promote logistics information sharing, and promote logistics cost reduction and efficiency improvement. In 2017, the national express delivery business totaled 40.06 billion pieces, an increase of 28%, ranking first in the world for four consecutive years.

  (E) E-government has been further promoted.

  The General Secretary of the Supreme Leader pointed out that it is necessary to deeply understand the role of the Internet in national management and social governance, and use information technology to better perceive the social situation, smooth communication channels, and assist decision-making. At the national level, the "National E-government Overall Plan" was promulgated, the national e-government overall coordination mechanism was established, the national e-government comprehensive pilot was organized, the application of e-government was continuously deepened, and the development experience of e-government that can be used for reference and promotion was explored to promote the modernization of the national governance system and governance capacity.

  "internet plus Party Building" serves the Party’s construction.In October 2017, the national party member Management Information System was launched, which provided an open information window for party member and built an integrated working platform for party organizations and departments at all levels. The upgrading of party member’s educational resource database continued to advance, with more than 20,000 websites of Party building established nationwide, 1,900 educational TV columns (channels) in party member and 6,900 educational mobile newspapers in party member. The National party member Modern Distance Education Network for Cadres has completed the revision and upgrading of the central platform, local platforms and more than 700,000 rural terminal sites, with more than 8.3 million registered users, making it the flagship platform for education in party member. Relying on the internet to strengthen the construction of the party’s youth mass work position.E-government improves the modernization level of governance.The General Office of the State Council issued the Implementation Plan for the Integration and Sharing of Government Information Systems to accelerate the integration and sharing of government information systems, promote network communication, data communication and business communication, and continuously extend e-government services to grass-roots governments. We will build a centralized accounting data system of the central bank and a statistical platform for the financial industry, speed up the development of e-government on currency, gold and silver, and better serve macro-control and prevent and resolve financial risks. The national 12315 Internet platform was put into operation, and the integration of market supervision information was steadily advanced.Outstanding achievements have been made in the construction of "smart courts".All 3,525 courts across the country have made the trial process, trial activities, judgment documents and execution information public, with more than 41.23 million judgment documents made public and the number of visits exceeded 12.4 billion. The world’s first Internet court was unveiled in Hangzhou, and 100% of the cases were heard online. The average court session took only 25 minutes and the average trial period was 32 days, which built a new space for online rule of law. 55% of the courts in China have filed cases online, and people’s courts have begun to step into the stage of electronic litigation.The construction of electronic inspection project has achieved remarkable results.buildIt has become a "six platforms" for judicial handling, inspection office, team management, procuratorial support, inspection decision support, procuratorial publicity and service of the four-level inspection organs nationwide, and all cases are handled online. "the Supreme People’s Procuratorate’s Opinions on Deepening the Construction of Intelligent Procuratorial Work" was issued and implemented, and the intelligent procuratorial work made great strides.New media for government affairs are developing vigorously.Party and government organs and mass organizations at all levels actively use Weibo, WeChat, client and other "two micro-ends" new media to release government affairs (party affairs) information, respond to social concerns, provide convenience services and promote collaborative governance, which has become an effective platform for building online and offline concentric circles and practicing the party’s mass line. Party and government organs at all levels have opened more than 510,000 government WeChat accounts in Tencent and more than 134,000 government Weibo accounts in Sina.Informatization innovates social governance model.Twenty-one provinces (autonomous regions and municipalities) have basically completed the construction and put into use of the comprehensive platform for comprehensive management information, and the comprehensive management video networking system has covered all provinces, 333 prefecture-level cities, 2,795 counties, 13,472 townships (streets) and other grassroots units. The public security organs have accelerated the application of new technologies, and constantly improved their capabilities and levels in prevention and control, mass service, and social governance. Remarkable achievements have been made in the construction of social credit system. The national credit information sharing platform has been connected to 39 ministries and commissions and all provinces, autonomous regions and municipalities, and the total amount of various credit information has exceeded 6.5 billion. The inter-departmental joint punishment for dishonesty and joint incentive mechanism for trustworthiness have been improved.

  (VI) Information benefits the people and convenience services are accelerated.

  In order to develop the network information business, we must implement the people-centered development thought. It is necessary to adapt to the people’s expectations and needs, speed up the popularization of information services, reduce the application cost, and provide useful, affordable and well-used information services for the people. All regions and departments regard informatization as an important means to protect and improve people’s livelihood, and vigorously develop information services such as online education, telemedicine, online culture, "internet plus Public Legal Service" and "internet plus Public Security", so that people can gain more sense in sharing the fruits of Internet development.

  "Internet+Education" expands the coverage of quality education resources.Significant progress has been made in the construction and application of "three links and two platforms", the level of educational informatization has been significantly improved, and the promotion mechanism of the whole society’s participation has been continuously improved. By the end of 2017, the Internet access rate of primary and secondary schools nationwide reached 90%, 3.6 times that of five years ago, and the proportion of multimedia classrooms reached 87%, which doubled. As of June 2017, the number of online education users reached 144 million, and the online education utilization rate reached 19.2%.The direct settlement of basic medical insurance for medical treatment in different places has been steadily advanced.A nationwide remote medical treatment system has been established, and all 31 provinces (autonomous regions and municipalities) and Xinjiang Production and Construction Corps are connected to the system, basically realizing the direct settlement of hospitalization expenses for cross-provincial remote medical treatment, and reducing the pressure of "running errands" and "paying for funds" for patients.The application of Huimin has accelerated its popularization.The national traffic card interconnection work has been promoted rapidly, with a total of 11 million cards issued, and the interconnection of 180 cities above prefecture-level cities has been completed. Build and improve the "12348 China Law Network" (public legal service network platform), use modern information technology to enhance the effectiveness of village legal consultants, and expand and optimize the supply of legal services. Actively promote the "internet plus Public Security" model, build a public security "Internet+government service" platform, improve service efficiency and extend service tentacles.Social security services have been continuously expanded.The number of social security card holders exceeds 1 billion, covering 99.7% of all provinces in China. It fully supports direct settlement of medical cards across provinces and places, and is widely used in employment registration, medical insurance settlement, pension payment, talent service and other social fields. In many areas, we have expanded the application of residents’ health, civil assistance, financial subsidies and other government public services, and initially established a collaborative sharing mechanism for information on old-age services and community services.

  (7) The deep integration of network information and military and civilian development has made solid progress.

  General Secretary of the Supreme Leader pointed out that online information integration of defense and civilian technologies is the key field and frontier field in integration of defense and civilian technologies, and it is also the most dynamic and potential field in integration of defense and civilian technologies. We should seize the historical opportunity of the current information technology revolution and the new military revolution, deeply understand the internal relationship between productivity and combat effectiveness, market and battlefield, grasp the working mechanism and laws of integration of defense and civilian technologies, and promote the formation of a pattern of all-factor, multi-field and high-efficiency deep integration of military and civilian development. In accordance with the central government’s strategic plan to promote the network power and integration of defense and civilian technologies, the relevant military and civilian departments have established and improved the working mechanism, improved the working system of the network letter integration of defense and civilian technologies, made overall plans to promote the in-depth development of the network letter integration of defense and civilian technologies, accelerated the cooperation between integration of defense and civilian technologies and the military in the network letter field, and strived to make the army serve the people and the people prepare for the army.

  The development of Netcom integration of defense and civilian technologies has been intensified.Issued and implemented the "Opinions on the Integrated Development of Economic Construction and National Defense Construction" and related plans, and the relevant military and civilian departments paid close attention to demonstrating and implementing a number of major demonstration projects in integration of defense and civilian technologies that have a bearing on the overall situation and long-term.The two-way transformation of military-civilian technology was accelerated.We will promote the joint construction and management of state key laboratories jointly built by the military and civilians, and strengthen the research and development of dual-use technologies for military and civilian use. The Catalogue of Intellectual Property Transformation of National Defense Science and Technology Industry (the third batch) released 400 pieces of information about intellectual property rights of national defense science and technology industry, which promoted the transformation and application of intellectual property rights of national defense science and technology industry. We implemented the "Military-civilian Standards Generalization Project", selected more than 100 military-civilian general national standards formulation projects, and issued 41 military-civilian general national standards formulation plans around key areas such as semiconductor integrated circuits and Beidou satellite navigation.The joint construction and sharing of information infrastructure and basic resources have been solidly promoted.Accelerate the application of high-scoring satellites, basically form a high-scoring data system covering different spatial resolutions, different coverage widths, different spectral bands and different revisit periods, deploy and implement 20 industry application demonstrations and 30 provincial industrialization demonstrations, and accelerate the construction of commercial satellite remote sensing systems. Issued the "Special Plan for Beidou System Application in Transportation Industry" to promote the implementation of a model project. Beidou’s application and industrialization have initially formed a complete industrial chain. The cumulative sales volume of Beidou chips has exceeded 50 million pieces, and high-precision OEM boards and receiver antennas have accounted for 30% and 90% of the domestic market share respectively.

  (VIII) International cooperation in the digital economy has yielded fruitful results.

  General Secretary of the Supreme Leader pointed out that all countries should promote open cooperation in the Internet field, enrich the connotation of openness, improve the level of openness, build more communication and cooperation platforms, create more points of convergence of interests, growth points of cooperation, and win-win new highlights, promote mutual complementarity and common development in cyberspace, and allow more countries and people to take the express train in the information age and share the fruits of Internet development. Relevant state departments focus on the implementation of the "Belt and Road" cooperation initiative, strive to establish an open and win-win digital economic cooperation system, encourage and support online information enterprises to go global, and promote international information exchanges and cooperation.

  International cooperation in digital economy has become a new bright spot.China initiated the G20 Digital Economy Development and Cooperation Initiative and the Belt and Road Digital Economy International Cooperation Initiative, actively promoted the negotiation of nearly 20 free trade agreements such as regional comprehensive economic partnership, deepened practical cooperation in cyberspace, and promoted the joint construction and sharing of the Digital Silk Road.The service system for enterprises to go global has been continuously improved.Further broaden the channels for overseas enterprises to obtain information services and strengthen the release of safety early warning information. The "Belt and Road" big data service system has basically taken shape, actively providing effective information and services to relevant enterprises, organizations and individuals involved in the "Belt and Road" construction. The central enterprises concerned should build a comprehensive service platform in cross-border electronic commerce to provide enterprises with online one-stop services such as investment, construction and procurement of overseas projects.Network letter enterprises go out and make breakthroughs.Accelerate the promotion of cross-border e-commerce, bike-sharing and mobile payment to provide services for global users, and information and communication enterprises actively participate in the construction of information infrastructure in more than 170 countries. The number of users of the global AliExpress platform exceeded 100 million. Bike-sharing business has been popularized and applied in 21 countries and regions around the world.

  (9) The comprehensive management of cyberspace has been significantly enhanced.

  Cyberspace is the spiritual home of hundreds of millions of people. Cyberspace is clear and ecological, which is in line with the interests of the people. Relevant state departments have accelerated the revision of the Measures for the Administration of Internet Information Services, issued the Regulations on the Administration of Internet News Information Services, formulated a series of normative documents on Internet information services, strengthened the management of basic Internet resources, strengthened the construction of Internet content, accelerated the establishment of a comprehensive network governance system, and created a clear cyberspace.

  The management of Internet basic resources has been further strengthened.The real-name rate of telephone users has reached 100%, and the protection of users’ personal information has increased. We issued and implemented the Notice on Further Strengthening the Management of Unregistered Websites and the Notice on Further Regulating the Domestic Domain Name Registration Service Market, and launched a special campaign for the management of Internet basic resources. The accuracy rate of website registration subject information exceeded 93%.Strengthen the positive publicity of cyberspace.Accelerate the construction of key news websites, solidly carry out the construction of network civilization, issue and implement the Trial Measures for Social Benefit Evaluation of Online Literature Publishing Service Units, carry out the construction of online publishing supervision system (Phase II), promote the dissemination of excellent online content, and actively cultivate a positive and healthy online culture.Strengthen cyberspace governance according to law.Strengthen departmental cooperation, actively use new technologies and applications, improve the ability to deal with and guide, clean up harmful information in time, and create a clean cyberspace for the majority of netizens, especially teenagers. Severely crack down on online telecom fraud in accordance with the law. In the first half of 2017 alone, 76,000 related cases were cracked, and losses of 7.58 billion yuan were recovered for the masses. In 2017, the number of fraudulent phone calls and text messages decreased by more than three quarters year-on-year.Vigorously promote "voluntary service in internet plus".Promote the universal establishment of volunteer service information systems in various places, and gradually realize the interconnection, co-construction and sharing of basic data of national volunteer service. There are more than 79 million registered volunteers in the information system, more than 420,000 registered volunteer service organizations, more than 1.05 million volunteer service projects, and more than 810 million hours of volunteer service have been recorded.Deeply participate in international governance of cyberspace.China actively participates in the cyberspace governance process of international organizations such as the United Nations and bilateral and multilateral forums, and conducts exchanges and dialogues with the United States, the European Union, Russia, Britain, France, Germany, Australia, New Zealand, ASEAN and other online information fields. Accelerate the "CNCERT International Partner" program and actively participate in the formulation of standards by international organizations such as ITU. We have established a cooperation mechanism for cyber security law enforcement with more than 70 countries and regions to promote bilateral and multilateral exchanges and cooperation.

  (10) The network security guarantee system has been continuously consolidated.

  Network security and informatization complement each other, security is the premise of development, and development is the guarantee of security. The promulgation and implementation of the Network Security Law has established the first basic, framework and comprehensive law in the field of network security in China. The publication of the National Cyberspace Security Strategy clearly declares and clarifies China’s major positions and propositions on cybersecurity to the world system. Relevant state departments should strengthen policy coordination and work coordination, and establish and improve the network security system.

  Establish and improve the network security policy system.All relevant departments have accelerated the formulation and improvement of the supporting regulatory documents of the Cyber Security Law, basically established the cyber security review system, and promulgated the Measures for the Security Review of Network Products and Services (Trial), the National Emergency Plan for Cyber Security Incidents, and the Measures for the Monitoring and Disposal of Cyber Security Threats on the Public Internet, and accelerated the formulation of the Regulations on the Security Protection of Key Information Infrastructure and the Regulations on the Protection of Cyber Security Levels. The standardization of network security has been accelerated, and a number of important national standards such as "Information Security Technology Personal Information Security Specification" have been issued.Strengthen the training of network security talents.Issued and implemented the "Administrative Measures for the Construction Demonstration Project of First-class Cyber Security College", and seven universities became the first batch of first-class cyber security college construction demonstration projects. Thirty-five colleges and universities have been awarded the first-class doctoral degree in cyberspace security, and the pace of training cyber security talents has been accelerating. Actively promote the construction of national cyber security talents and innovation bases.Strengthen the research and development of network security technology and supervision and security.Efforts should be made to break through the key technologies of network security, and new technologies should be laid out in advance to realize the security and reliability of network core technologies, key infrastructure and information systems and data in important fields. The public security organs organized law enforcement inspection and technical inspection of network security for more than 27,000 units, rectified and eliminated a large number of network security loopholes, and successfully completed a series of network security work for large-scale activities.

  Third, the priority action of digital China has continuously enhanced the people’s sense of gain

  People’s yearning for a better life is the priority direction of the construction of digital China. In the past five years, all regions and departments have focused on filling shortcomings and layout frontiers. Promote the implementation of 12 priority actions, including the advanced deployment of new generation information network technology, Beidou system construction and application, application infrastructure construction, data resource sharing and opening up, "Internet+government service", beautiful China informatization special action, network poverty alleviation action, new smart city construction action, online Silk Road construction action, network culture prosperity action, online education inclusive action, and healthy China information service action. Accelerate the construction of modern infrastructure, effectively help the rural population get rid of poverty, promote the development of social undertakings, strengthen the protection of the ecological environment, and constantly enhance the people’s sense of acquisition, happiness and security.

  (A) the advanced deployment of the new generation of information network technology

  Important breakthroughs have been made in the research, development, testing and verification of 5G network technology.The "New Generation Broadband Wireless Mobile Communication Network" is a major national science and technology project. At present, the design and development of 3G SPS 12-bit ADC/DAC, PA, wide-area hotspot baseband chip and low-latency baseband chip have been realized, and the research and development of key technologies such as 5G core network and ultra-dense networking based on SDN/NFV are constantly advancing. The rapid development and testing of 5G, and the release of the first batch of specifications in the third phase of the trial, are promoting the formation of a global unified 5G standard.The carrying capacity and access capacity of radio and television networks have been improved.Promote the two-way entry of radio and television and telecommunications services nationwide. Accelerate the pilot project of the second phase of the radio and television cable and wireless satellite convergence network, and approve the technical scheme and three standards for the convergence network test in 11 provinces. The number of IPTV users in China has reached 122 million.The overall evolution and upgrading of IPv6 is accelerated.Issue and implement the Action Plan for Promoting the Scale Deployment of Internet Protocol Version 6 (IPv6) to accelerate the construction of the next generation Internet with high speed, wide popularization, full coverage and intelligence. The number of IPv6 addresses in China is 23,430 /32, up 10.6% year-on-year.

The construction of Beidou-3 system was accelerated. In November 2017, January and February 2018, six networking satellites were launched with "one arrow and two stars" for three consecutive times, which opened a new journey of global networking of Beidou satellite navigation system.

  (3) The innovation capability of application infrastructure has been significantly enhanced.

  The independent innovation capability and service capability of cloud computing have reached a new level.We issued and implemented the Opinions on Promoting the Innovation and Development of Cloud Computing and Cultivating the New Format of Information Industry and the Three-year Action Plan for Cloud Computing Development (2017-2019) to promote the popularization of cloud computing applications, optimize the layout of cloud computing data centers, improve the utilization rate and intensive level, and form an internationally competitive industrial system. Breakthroughs have been made in key technologies such as large-scale concurrent processing, massive data storage and energy saving in data centers, and internationally competitive cloud computing platforms such as Ali Feitian Platform, Baidu Brain and WeChat Open Technology Platform have emerged. In 2017, the scale of China’s public cloud market is expected to reach 24.6 billion yuan, a year-on-year increase of 44.7%.New breakthroughs have been made in the large-scale and intensive development of data centers.In 2016, the proportion of large and super-large data centers in China increased from less than 8% in 2010 to 25%. There are 295 enterprises with large data centers and trans-regional Internet data services.The pace of deep integration and extensive application of the Internet of Things has accelerated.The research, development and deployment of narrowband Internet of Things (NB-IoT) technology are accelerating. China Telecom has built the world’s first commercial NB-IoT network with the widest coverage, and 310,000 base stations in the whole network have been upgraded simultaneously. The NB-IoT technical scheme proposed by Huawei was approved by 3GPP and became an international standard. NB-IoT accelerates the expansion to public facilities management, production and life, and accelerates the intelligent transformation of infrastructure such as power grid, railway and highway.

  (4) The sharing and opening up of data resources has been steadily advanced.

  A national information resource sharing system has taken shape.Formulate and implement the Interim Measures for the Management of Government Information Resources Sharing and the Guidelines for the Compilation of Government Information Resources Catalogue (for Trial Implementation). A unified data sharing and exchange platform was initially established, with the total number of data sharing and exchange reaching 12 billion. The national e-government extranet has connected 130 central units and 244,000 local units, carrying 13 national applications. The national population basic information database realizes the sharing of 13 basic information, and the national legal entity basic information database realizes the sharing of 9 basic information.The opening of public information resources in key areas was accelerated.Issued the "Pilot Work Plan for the Opening of Public Information Resources", and carried out pilot projects for the opening of public information resources in five provinces (cities) including Beijing, Shanghai, Zhejiang, Fujian and Guizhou. Vigorously promote the construction of four platforms, such as credit information sharing, online approval and supervision of investment projects, 12358 price supervision and public resource trading, and promote the sharing and opening up of information resources such as social credit and public resource trading. The open cloud platform of comprehensive transportation travel big data has accessed 112 original data, 26 service data and more than 7TB of open data from 25 transportation authorities and 41 enterprises. The national enterprise credit information publicity system realizes the unified collection and sharing of enterprise-related information among government departments, with a query volume of 16.98 billion person-times, which provides support for strengthening supervision during and after the event. The national food and drug supervision data sharing platform supports cross-departmental, cross-level and cross-regional information sharing and multi-departmental joint disciplinary incentives.Local governments actively explore new models.31 provinces (autonomous regions and municipalities) have issued policy documents related to the opening of public information resources.   (E) "Internet+government services" to deepen the "streamline administration, delegate power, strengthen regulation and improve services" reform

  Open government affairs and further standardize government services.In-depth implementation of the Guiding Opinions on Accelerating the Work of "Internet+Government Services", issuance of the Guide for the Construction of the Technical System of "Internet+Government Services" and the Detailed Rules for the Implementation of the Opinions on Promoting Government Affairs Openness in an All-round Way, formulation of the Pilot Work Plan for the Standardization of Grassroots Government Affairs Openness, and implementation of the pilot in 100 counties (cities, districts) in 15 provinces. By the end of June 2017, 71 departments and directly affiliated institutions in the State Council had opened government websites, and 92.9% of them had established information dissemination systems.An online and offline integrated government service platform has basically taken shape.By the end of December 2017, 31 provinces (autonomous regions and municipalities) and Xinjiang Production and Construction Corps had all published the power list of provincial government departments, and the provincial online government service platform had published a total of 54,440 service guides, online handling and results inquiry services for government services, and launched 31 provincial online government service platforms. Zhejiang, Jiangsu, Fujian, Shanghai and other places rely on "Internet+government services" to break through departmental data barriers and innovate modes such as "running at most once" and "not meeting for approval", so that information can run more and people can run less errands.

  (VI) Informatization helps the construction of ecological civilization

  The construction of ecological environment monitoring network has achieved remarkable results.An environmental air quality monitoring network consisting of automatic air monitoring stations, acid rain monitoring stations and sandstorm monitoring stations has been built and used. More than 350 monitoring centers at the Ministry, provincial and municipal levels have been built, and more than 130 automatic radiation environmental monitoring stations have been deployed in 96 prefecture-level and above cities, and more than 10,000 enterprises and 16,000 monitoring points have been automatically monitored, initially forming an innovative management model of data management, data service and data decision-making. The construction of the national marine ecological environment supervision and management system has been basically completed, and the national sea area dynamic monitoring and monitoring functions have been continuously enriched.The dynamic monitoring and supervision of natural resources have been continuously improved.The first national survey of geographical conditions was completed, and China’s geographical conditions were obtained comprehensively and accurately for the first time. The "One Map of National Land and Resources" has been completed and improved, and a land and mineral resources management information system covering the whole country and running through four levels has been formed. The construction of networked supervision information system has been steadily promoted, and the main links of land and mineral resources development and utilization in the whole country have been basically tracked and supervised regularly before, during and after the event. Accelerate the construction of information engineering for ecological environmental protection, and establish the information sharing mechanism for natural resources supervision. The information types and functions of "One Map of National Water Conservancy" have been further improved, and the effectiveness of water-related information integration has been continuously strengthened."internet plus" made a major breakthrough in smart energy.The construction of energy internet is in the forefront of the world. The length of UHV lines under construction in China has reached 35,000 kilometers, and the annual transmission power exceeds 400 billion kWh. We launched 55 "internet plus" smart energy pilot demonstration projects, initiated the establishment of a global energy Internet development cooperation organization, and proposed the Action Plan for Global Energy Internet to Implement the UN 2030 Agenda for Sustainable Development.

  (7) The effectiveness of network poverty alleviation has been remarkable.

  Coordinate and promote the network poverty alleviation action.We formulated and implemented the Network Poverty Alleviation Action Plan, and made overall plans to promote the construction of five major projects, namely, network coverage, rural e-commerce, network intelligence support, information service and network public welfare, and achieved remarkable results.Network coverage project speeds up bridging the "digital divide" in poverty-stricken areas.Universal telecommunications service was implemented in depth. In 2017, the third batch of pilot projects for universal telecommunications service was implemented, supporting 12,000 poor villages to connect optical fibers. The annual growth rate of fixed broadband household users in 832 key poverty alleviation and development counties and counties in contiguous poverty-stricken areas exceeds 20%, and the annual growth rate of mobile broadband users exceeds 30%. The proportion of broadband access in poverty-stricken villages with established files has exceeded 90%.The role of rural e-commerce projects in poverty alleviation is increasingly obvious.Promote the comprehensive demonstration of e-commerce in rural areas to lean towards poverty-stricken counties, and bring 499 state-level poverty-stricken counties into the scope of support, accounting for 60% of all poverty-stricken counties, which will drive the income of 2.74 million poor households who set up files and set up cards.   (8) Promote the classification of new smart cities.

The service capacity of the "Belt and Road" spatial information corridor has basically taken shape, providing spatial information services for Chinese enterprises to go global and more than 30 countries and regions along the "Belt and Road".The information-based international hub project has been solidly promoted.China-Arab online Silk Road Economic Cooperation Experimental Zone and Ningxia Hub Project have been accelerated, and the construction of China-ASEAN information port has achieved initial results. The achievements of key projects such as China-ASEAN cross-border trade settlement platform and China-ASEAN new smart city collaborative innovation center have gradually emerged.Cross-border electronic commerce continues to develop rapidly.Thirteen comprehensive experimental zones in cross-border electronic commerce, such as Hangzhou, actively explored the establishment of a management system with "six systems and two platforms" as the core, and formed mature experiences and practices in 12 aspects, which were replicated and promoted nationwide.   (10) Prosperity and development of network culture.

The cumulative downloads of People’s Daily news clients exceeded 210 million times, Xinhua News Agency clients reached 250 million times, and CCTV’s "CCTV Audio and Video" clients reached 610 million times.The management of online game market is constantly standardized.The Opinions on Strictly Regulating the Management of Online Game Market was issued and implemented, and centralized rectification actions were carried out against illegal behaviors and bad contents of online games. A comprehensive inspection of the national online game market was basically completed, and more than 5,000 online game business units were inspected and arranged, with more than 100,000 online games. The content such as value-oriented deviation and vulgar violence was greatly reduced, and the main business behavior of enterprises was standardized.Vigorously develop online literature and art.Solidly promote the construction of network culture in colleges and universities across the country, promote the network dissemination and promotion of socialist core values, enhance the sense of the times and appeal, and make the network culture of colleges and universities a powerful engine and inexhaustible source of positive energy in cyberspace.   (XI) Inclusive development of online education

  The construction and application of "three links and two platforms" have achieved remarkable results.The "broadband network school-to-school communication" has developed rapidly, the popularization of "high-quality resource class-to-class communication" has deepened, and the "online learning space for everyone" has developed by leaps and bounds. The public service platform for educational resources has begun to take shape, with 68 million registered users and access to hundreds of applications. The public service platform for education management has been fully applied, and the information pattern of education management of "two-level construction and five-level application" has basically taken shape.Promote the development of online education.Identify the first batch of 490 national quality online open courses, continuously enrich online digital education resources, and push online education inclusive action to a new level.The digital divide between urban and rural schools has narrowed rapidly.According to local conditions, Anhui Province pioneered high-quality schools with weak schools and achieved full coverage of more than 4,900 teaching points.   (XII) A healthy China information service system has basically taken shape.

  Fourth, the development of informatization in various regions has been accelerated.

  In order to better evaluate the progress of implementing the Outline of National Informatization Development Strategy and the Thirteenth Five-Year National Informatization Plan in various regions, the National Internet Information Office organized relevant units, and combined with the statistical data and indexes of the National Bureau of Statistics, the Ministry of Industry and Information Technology, CNNIC and other departments and institutions, designed an evaluation index system for China’s informatization development, mainly including information service application, information technology industry, industrial digitalization, information infrastructure, network security and policy environment. The higher the index value, the better the effect of regional informatization development.

  The comprehensive index of 10 provinces (cities) such as Beijing, Guangdong, Jiangsu, Zhejiang, Shanghai, Fujian, Tianjin, Chongqing, Sichuan and Hubei is above 65, and the level of informatization development is at the forefront of the country. The above-mentioned areas attach great importance to informatization, and all of them have issued the "Thirteenth Five-Year Plan" for informatization or smart city planning, laid out a new generation of information infrastructure ahead of schedule, and actively promoted innovation in the information technology industry. The digital economy has developed rapidly, information services are universal and efficient, and digital dividends have been released faster. Informatization has played an obvious role in promoting regional coordinated development.

Actively promote the coverage of information services such as education, medical health, social security and culture in urban and rural areas, deepen the development of information to benefit the people and facilitate the people, and significantly improve the satisfaction of the people.

  (C) the rapid development of information technology industry

  Ten places, including Guangdong, Jiangsu, Beijing, Zhejiang, Shanghai, Shandong, Fujian, Sichuan, Hubei and Tianjin, rank among the top ten in the information technology industry index of various provinces (autonomous regions and municipalities). The above-mentioned areas attach great importance to the development of information technology industry and the construction of ecological system. They have issued relevant plans and action plans to promote the development of information technology industry, strengthened the leading role of information technology innovation, laid out innovation chain around the industrial chain, upgraded the value chain with innovation chain, accelerated the development of a new generation of information technology industry, fostered and expanded the electronic manufacturing industry, software and information technology service industries, and promoted the wide application of big data in various fields of economic and social development, with the leading role of industrial innovation development and radiation being significantly enhanced.

"Solving the water environment problem has strong strategic significance." The goal of "Water Ten Articles" is: by 2020, the national water environment quality will be improved in stages, and the water ecological environment in Beijing-Tianjin-Hebei, Yangtze River Delta and Pearl River Delta will be improved. By 2030, we will strive to improve the overall quality of the water environment in the country and restore the functions of the water ecosystem initially. The effect of expanding industry is obvious, which is expected to boost GDP growth by about 5.7 trillion yuan.

Ren Nanqi said that the "Water Ten Rules" will definitely have an impact on the industrial economy, but it is also a good condition for creating a level playing field. "For enterprises, the implementation of the new environmental protection law has brought good influence, the consciousness of pollution control of enterprises is improving, and the competitive advantage of enterprises will also be reflected in the ability and level of environmental governance."

Fu Tao, president of E20 Environmental Industry Research Institute, said that according to relevant calculations, by 2020, it will take about 4 trillion to 5 trillion yuan to complete the corresponding goal of "Water Ten"; Among them, the investment in the past three years is about 2 trillion yuan, which requires local governments at all levels to invest about 1.5 trillion yuan.
